We have developed exclusive referral and service relationships with several elderlaw attorneys in the greater Boston area and beyond. Each of our team attorneys has particular expertise in certain areas of the law. After completing our comprehensive caregiving assessment, we recommend to our clients various legal services that should be undertaken to meet their caregiving goals and needs.

     

Many families confronted with a caregiving crisis have not always taken the necessary steps to provide for even the most basic legal documents. These so-called basic documents include certain advance directives such as Durable Power of Attorney, Health Care Proxy, Living Wills and even Simple Wills. As a service to our clients, we have established a convenient and timely process with one of our elderlaw attorneys to prepare and deliver those documents by mail. No office appointments are necessary.

We offer education, advocacy and referral for Guardianship / Conservatorship services. Working together with an elderlaw attorney who is a recognized expert in guardianship law, we have developed an expedient process for preparing all of the legal documents necessary to petition the court for guardianship status. In most cases, the guardianship petition is approved in less than 15 days for a Temporary Guardianship and 60 days for a Permanent Guardianship. Unless the petition is contested, our clients are not required to make any court appearances. All of the necessary paperwork requiring signatures are sent and returned by express mail.

Our elderlaw attorneys are also available to assist clients with many different legal services. Obviously the need for legal services will vary from client to client. In some cases, clients are referred to ParentCareUSA at a time when certain sophisticated estate planning strategies are no longer useful or helpful to their parents or loved ones due to Medicaid timing issues and "look-back" periods. In those cases, our work is primarily focused on asset preservation strategies and usually does not require any involvement by our legal team. On the other hand, we work with other clients who do not have the same timing constraints and consequently many more planning options are available to them. Some examples of these planning options include supplemental needs trusts, family and realty trusts, lifetime and testamentary trusts and family limited partnerships. We are always pleased to refer those clients to our team of elderlaw attorneys for immediate assistance.

We are committed to doing whatever we can to ensure that the "baby boomer" generation is much better prepared to deal with aging issues than their parents. Though the lesson was learned the hard way, many of our clients understand that their parents or loved ones may have benefited more from an earlier intervention by a qualified elderlaw attorney. As a result of their caregiving experiences, many clients have asked us to assist them with their own planning needs even though the prospect or likelihood of long term care is 10-20 years on the horizon. Working with one of our elderlaw attorneys, we have developed a program to provide "baby boomers" with legal services custom tailored to meet their long term planning needs.
